Terms of Service

1. Agreement

These Terms of Service (“Terms”) are an agreement between you and TimeCapsule regarding the website and services at https://locker.timecapsule.company (the “Service”).

If you do not agree, do not use the Service. Additional policies, including our Privacy Policy, Cookie Policy, and Acceptable Use Policy, form part of these Terms.

2. Eligibility

You must be at least 16 years old (or the age of digital consent in your country) and able to form a binding contract to use TimeCapsule. You are responsible for your account credentials and for activity under your account.

3. The Service

TimeCapsule lets you create digital capsules containing messages and files, seal them until an unlock date or condition, and (optionally) share them privately, by invite/code, or publicly on Discover.

Features, storage limits, pricing, and free tiers may change. Paid features, if offered, are subject to the pricing shown at purchase and any applicable billing terms.

4. Accounts

• Provide accurate account information and keep it updated
• Keep passwords confidential; notify us of unauthorized use
• You may sign in with email/password or supported social providers such as Google
• We may suspend or terminate accounts that violate these Terms or pose a security risk

5. Your content

You retain ownership of content you upload (“User Content”). You grant TimeCapsule a worldwide, non-exclusive license to host, store, process, transmit, and display User Content solely to operate and improve the Service as you configure it (including public Discover display when you choose public visibility).

You represent that you have all rights needed to upload and share your User Content, and that it does not violate law or others’ rights.

Sealed content is designed to remain inaccessible until unlock rules are met. You understand that misconfigured public settings, shared links, access codes, or invited recipients can expose content to others.

6. Acceptable use

You must follow our Acceptable Use Policy. We may remove content or restrict access when we reasonably believe there is a violation, legal risk, or harm to users or the Service.

7. Availability and changes

We aim for reliable uptime but do not guarantee uninterrupted or error-free service. We may modify, suspend, or discontinue features with reasonable notice when practicable.

8. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

Capsule delivery depends on correct dates, settings, account access, and continued operation of the Service. Keep your own copies of critical materials when appropriate.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TIMECAPSULE AND ITS OPERATORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $50, EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY LAW.

10. Indemnity

You agree to defend and indemnify TimeCapsule against claims arising from your User Content, your use of the Service, or your violation of these Terms or applicable law.

11. Termination

You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms, if required by law, or if we discontinue the Service. Provisions that by nature should survive (including ownership, disclaimers, and liability limits) will survive termination.

12. Governing law

These Terms are governed by the laws applicable in the jurisdiction where TimeCapsule operates, without regard to conflict-of-law rules, except where mandatory consumer protections in your country apply.
